To ask the Secretary of State for Levelling Up, Housing and Communities, whether he has had recent discussions with the London Borough of Havering on tackling mould in council accommodation in Romford constituency.

All landlords have legal obligations to remedy disrepair, ensure homes are fit for human habitation and to ensure that homes are free of serious ‘category 1’ hazards, as defined through the Housing Health and Safety Rating System. As a registered provider of social housing, the London Borough of Havering is also required to ensure its homes meet the Decent Homes Standard.

Following the death of Awaab Ishak, the Secretary of State wrote to all providers of social housing, including the London Borough of Havering, setting out that he expected providers to go further than the letter of the Decent Homes Standard and have particular regard to damp and mould. He also wrote to local authority chief executives and council leaders setting out his expectation that they take action to resolve poor housing conditions in their area.

The Government is taking action on damp and mould. We have introduced ‘Awaab’s Law’, which sets out new requirements for landlords to address hazards such as damp and mould in social homes within a fixed time period. We published our consultation on 9 January 2024. We have also, with the Department of Health and Social Care, developed new consolidated guidance for the housing sector on the health impacts of damp and mould in homes. This guidance was published in September 2023.

Question to the Department for Levelling Up, Housing & Communities:

To ask the Secretary of State for Levelling Up, Housing and Communities, what assessment his Department has made of the feasibility of arrangements to fund the (a) training and (b) qualifications of London council staff under the Regulator for Social Housing's new regulatory regime through council Housing Revenue Accounts.

The department has noted the analysis by Savill’s and has regular engagement with councils, including in London.

The department does not economically regulate local authority registered providers’ HRA finances but does work with local authorities and representative bodies to examine the problems that are common to all landlords, and to gain intelligence from practitioners on measures that have been taken locally, and how these might be adapted to the wider environment. Nonetheless, it is for councils to meet their statutory responsibilities to keep their homes to a safe, decent standard. The revised consumer standards and changes to the role of the Regulator of Social Housing will help to ensure that happens. Local authorities have wide discretion on how to prioritise their spending within the HRA to meet their statutory and other commitments.

The regulatory changes which come into effect on 1 April have been assessed to be affordable to the sector. Impact assessments were published for the Social Housing (Regulation) Act 2023, the publication of the revised consumer standards, and for the ongoing consultation on competence and conduct requirements. All future regulatory changes, including to the Decent Homes Standard, will also be subject to consultation and impact assessment.

To ask the Secretary of State for Levelling Up, Housing and Communities, what estimate he has made of the number of illegal migrants living in council housing.

Illegal migrants are not eligible for an allocation of social housing and cannot be granted a social housing tenancy, therefore the department does not collect such data.
